ATLANTA, GA (June 29, 2007) - An eBay seller of rocks and mineral collectibles has obtained an Injunction against the industry giant, signed by the Magistrate Court of Fulton County on June 21, 2007. Tammarah Davis (eBay ID "tigereye" http://www.mysticgemcreations.com) and her husband representing themselves met with eBay's attorney prior to a Court Hearing about their action against eBay, which is currently in Arbitration. The Order prevents eBay from damaging her business reputation, including any action against her powerseller status.



"eBay relies on the users of their site to report policy violations and even illegal practices", said Mrs Davis, "and that's fair and reasonable given the nature of this business. There is just too much out there - it takes all of us together to keep everyone honest. I am in the same boat with enforcing my rights and this Injunction. It will take a lot of watchful eyes throughout the Internet community." Contact information for Mrs Davis can be found at her commercial website.

Thank you Jo Smile I had written about the dispute before details became confidential, but fortunately an Order in open court isn't covered by that. As I promised, I'll provide public details here before anywhere else.

Tammarah is thrilled with your well-wishes! We feel like we're battling for more than just our own rights, and we can feel awfully isolated and outnumbered when you can't even tell anyone what's going on.

Hi Kathy, Erin and others! The encouragement is a breath of fresh air.

Just so there's no misunderstanding, this battle is still ongoing. It's not a final judgment order that awards anything yet, other than raising the stakes and ordering eBay against doing anything against our business reputation while it's going on.

It does have implications for other sellers though, in and of itself. It shows that you can fight, and should never lose hope.

I'm hopeful as this progresses forward Bill that you can share more details. I'm of the opinion, right now, that this injunction means 'positive' for you all (long-term) and many others - as you suggest.

When this get's done, you really need to find a great avenue for sharing the outcome. I'm beginning to think that while ebaY has tons of power and control over content on the site, the power and control over individual members and those members' business and reputations is shifting - whether they like it or not.

All great journeys begin with a single step. I'd say this was a pretty good size step too!

Ebay has to be accountable for their actions that affect a reputation. Seems the court is on the right track.

Erin, rest assured that no matter what the outcome I intend to share whatever details I'm allowed to publish by the decision or agreement. I expect that will include not only navigating the paperwork maze of various venues but also what I've learned about the way these things actually take place.

Everyone has the right to insist that their side of a dispute is heard - no matter who is ultimately right, no matter who they are or what the specifics are they have the right to be heard. I hope that my experience can help make that possible for other sellers finding themselves in this kind of situation.
