EBay Inc. said Wednesday that it faces a purported antitrust lawsuit in California over its PayPal unit, alleging that the company improperly monopolized the forms of payment sellers can use on its popular online auction Web site.

EBay, of San Jose, Calif., said the plaintiff filed the suit this month and seeks treble damages and an injunction. EBay believes it has "meritorious defenses" and intends to defend itself "vigorously," according to a filing with the Securities and Exchange Commission.

My first instinct is to side with the plaintiff.

Since this lawsuit is in very consumer friendly California, I suspect ebay will not do much vigorous defending.

I'm hoping it sticks and I'm surprised that Google didn't bring the suit themselves but they're wise in holding back and letting the state wage the war.

As for ebay - what could their defense be? I'm sorry...I'm just a big overstuffed pig that needs all the revenue I can get?

their defense would be: we're a venue (remember that?), so it's our site & we can do whatever we want on it.

At some point the law is going to figure out that "we're just a venue" routine LOL

im actually surprised it took this long. ebay isnt accepting the payment, the seller is. telling them they can only accept mastercard and american express but not visa would never have gone over. sellers should not have restraints on which payments they accept and which they dont, regardless of "venue". if you set up at the local mall they wouldnt tell you which methods of payments you could and could not accept. i honestly dont know how they have gotten away with it this long.
