This could prove to be very interesting. Craiglist's has the tenacity, and access to legal support to go toe to toe with eBay. Reading between the lines of the complaint filed by Craigslist, eBay, among other things, milked Craig's for proprietary info as to the internal structure and operation of Craig'slist, then applied it to their development and promotion of Kiji.
Perhaps Craig'slist will get their corporate shares back plus some additional operating cash. Like I say, could prove interesting. |

The proprietary info info part alone could be bad for eBay as they have already lost that suit about BINs. So they have a track record of "stealing" proprietary info.

April 1 (Bloomberg) -- EBay Inc. executives’ threats to take over Craigslist Inc. forced the online-advertising company’s managers to take defensive measures to ward off the Internet auctioneer, Craigslist lawyers said in court papers.
Craigslist’s board acted in the closely held company’s best interest when implementing protective measures including changing its stock structure, attorneys for San Francisco-based Craigslist said in briefs in a Delaware Chancery Court lawsuit over the changes.
Craig Newmark and Jim Buckmaster, Craigslist’s owners, “acted honestly and in good faith to protect Craigslist from a powerful adversary that exploited its position as shareholder and board member to obtain and misuse confidential information to develop competing businesses and repeatedly threatened to take over the company,” attorney Anne C. Foster said in the March 27 filing unsealed today.
EBay bought a 28 percent stake in Craigslist in 2004. It is asking Judge William B. Chandler III to find Newmark and Buckmaster violated Delaware corporate law by issuing shares to themselves to dilute the company’s stake.

"Court Expected to Rule Soon in eBay v Craigslist"
The Delaware Court of Chancery may issue a ruling soon in the eBay v Craigslist corporate governance lawsuit. The trial took place in December and post-trial motions have been filed and were fully briefed as of the middle of May.
eBay, which purchased a 28% stake in Craigslist in 2004, filed a lawsuit against the classifieds site when founder Craig Newmark and President Jim Buckmaster adopted measures that diluted eBay's shares, resulting in eBay losing its seat the board of directors. Newmark and Buckmaster said it was a defensive move made after eBay launched its own classifieds service in the U.S.
Some big names in ecommerce testified before the Court, including Newmark, Buckmaster, and eBay founder and Chairman of the Board Pierre Omidyar, as well as former eBay CEO Meg Whitman, now running for governor of California.

I just be happen to be looking for something and tripped over this, WOW!
I will highlight this sections but add the link to the whole thing. I also didn't realize ebay had like a porno site, or something like it in another country :shock: they own it somehow...the information is there too. ebay is crazy, tsk tsk tsk! However, I am not surprised

"Craigslist Sues eBay Founder Pierre Omidyar in Amended Complaint"
Craigslist sued eBay founder and Chairman of the Board Pierre Omidyar along with former eBay executive Josh Silverman, adding them as defendants in its lawsuit against eBay. In its third amended complaint in Craigslist vs. eBay, Craigslist charged Omidyar, Silverman and eBay with disseminating and misusing Craigslist's confidential proprietary competitive information in order to compete unfairly, among other allegations. Craigslist also filed new claims for securities fraud and negligent misrepresentation.
Omidyar had represented eBay on the Board of Craigslist in addition to serving as Chairman of the Board at eBay after it had acquired 28 percent of Craigslist in 2004. Silverman, who took over from Omidyar as eBay's representative on Craigslist's Board, led the development of eBay's European classifieds business. He was later named CEO of Skype, and abruptly stepped down from the company earlier this month.
The lawsuit was filed after eBay had first sued Craigslist in Delaware when Craigslist tried to lock eBay out of its Board, and Craigslist's lawsuit was on hold until the corporate governance lawsuit was wrapped up.

"Judge denies eBay's bid to dismiss Craigslist suit"
EBay Inc. must face a lawsuit claiming it fraudulently hid its intention to start a competing classified advertising site during negotiations to buy a stake in Craigslist Inc., a judge tentatively ruled.
Superior Court Judge Richard Kramer in San Francisco on Thursday rejected eBay's argument that Craigslist's lawsuit should be dismissed because shareholder agreements between the companies allowed them to compete.
"The third amended complaint is replete with all kinds of fraud that allegedly occurred after the agreements were entered into," Kramer said at a hearing.
The San Jose e-commerce company was sued by San Francisco's Craigslist in 2008 on claims that it fraudulently used confidential information obtained during negotiations while secretly preparing to start rival businesses.
EBay bought a 28 percent stake in Craigslist in 2004; in 2007, it developed an online classified site called Kijiji. The site was renamed EBayClassifieds.com.
Kramer also rejected eBay's contention that the lawsuit was precluded by the findings of a Delaware court that eBay didn't hide its intentions.
