Regarding the egg question:
In taking the eggs, where were they taken to and by whom?
Are the eggs still in existence and therefore still the property of the first party?
Where the three eggs taken without permission of the original owner by another who cannot legally claim ownership but mere possession? In that case isn't the original owner actually in ownership of all seven eggs though not in possession of three of his owned property?
If the original party took three eggs "away," do they now have the four eggs left or the three eggs taken; when they took three of the eggs did they either voluntarily or involuntarily forfeit possession of the remaining four? Or, if the ownership and possession of both sets of eggs remain with the original owner though in split locations, do they have all seven eggs?
If the original owner of the seven eggs took three eggs and made an omelet, consuming same omelet themselves and allowing their body to metabolize and use the nutrients from the eggs, are they still not in effective, though modified possession of the eggs?
There are no simple answers to most questions; whether on a test or in real life application. Just one of the reasons why the law schools are over populated along with society being overpopulated with the alumni spawned from those schools. There's money to be made interpreting and rationalizing the many different perspectives of even the simplest of circumstances. |

I think waaaaaaay back when this thread was started there were a couple of bugs to work out, thus a TEST thread was created which was never locked or removed. |
