Intertraders.eu reports that the Tribunale di Messina, an Italian court in southern Italy, has ordered eBay Europe to reactivate the account of Arcapel (user ID: www_arcapelsrl_it), an Italian ecommerce corporation. According to Rocco Gianluca Massa, Editor of InterTraders.eu, eBay had suspended Arcapel's account after it received two negative feedback ratings (with a positive rating of 440) from two buyers.

Dr. Massa said Arcapel sued eBay after its suspension, and said, "The judge ordinance is very important because it is one of the first Italian pronunciations in online auction matter, and the first that condemn eBay, highlighting some irregularities on eBay's Italian User Agreement," referencing "the "ease" with which the auction provider suspends Italian users."

Excellent.

No matter how fair or clear your user policy is stated, when you utilize data that is potentially arbitrary, then your policies become arbitrary. There is no standards of seller performance being used by buyers or even standards of care for the use of FB by buyers, and absolutely zero protection from capricious misuse of FB.

Interesting indeed.

I wonder when eBay will reinstate the user? :o

A quick check shows that eBay user "www_arcapelsrl_it" is still NARU.

Good that it happened but I suspect they will dispute it as far as they can, as this will really make a joke of their system and the next step will be for the seller to go for loss of earnings.

Ebay will always be fighting a loosing battle with any argument on stating they agreed to our terms, as they rolled over the sellers terms when they tried to argue that the buyer had agreed to their terms when bidding.
