Sellers on eBay Motors began receiving checks this month that were their portion of a $30 million settlement in a class action lawsuit. Two sellers had filed a class action lawsuit against eBay in 2009 alleging that eBay charged excessive fees for listing items in the "Parts and Accessories" category. eBay settled for $30 million in November, but denied it had overcharged sellers.

The court approved the settlement in December, and sellers began receiving checks this month.

The class consists of eBay sellers who paid Final Value Fees for selling items in the vehicle-related Parts and Accessories categories on eBay Motors between April 21, 2005, and August 26, 2009. eBay Store listings were not included in the settlement.

Very interesting considering they are OVER CHARGING on final value fees on every single shipping refund a seller generates. I've had $15.00 stolen just on the test auctions I've run. They are violating their own TOS which clearly says I to pay 7% final value fee on the shipping I charge customers. There is no excuse for not automatically generating this refund - paypal auto refunds its fees.. They simply want to steal the money. LOL, a cusomter service rep actually told me "we are not profiting from the situation". What the hell - eBay's system only acts just how it was designed - HAL from 2010 is not suddenly in charge and its out of eBay's human hands.

I got 16 cents.

In case anyone really needed an answer if suing ebay was viable, know the lawyers got 7.5 million, users got pennys.

And it cost more to print the checks than the value on the checks.

Waste of time.

Typical! Lawyers fees generally run in the 30% range. That means these particular lawyers might have made enough to purchase another private jet or island. :roll:
What are you all going to do with your $$$$$?????

Ebay only has to overcharge one million customers a dollar per day on their fees-that can be scattered among their invoice fees which most members will not even notice (since the invoices are so long and complicated)....and THAT would rack up Ebay a MILLION DOLLARS per DAY. They have the PERFECT situation for 'adding' these little errors that go unnoticed.

Have you checked YOUR invoices lately?

In addition to what seewhatimsellingnow has stated - eBay has already got this money back - they are stealing 9% of every shipping refund generated through paypal. Their automated system only works as it was designed to work - it can't think for itself, thus this is intentional.

Where is my check also. I bought the inventory of a auto parts store and was running up to 1200 auctions for parts in one account. So how eBay treat me - they moved 396 of 400 auctions one week into a new category called "other". Not the way to treat your #1 lister in the category. And then they told me not to worry because categories are not that important because their search engine is the primary mover of items. They can't even lie good - I should at least get some good lies out my fees I am paying.

From what I read this case is just about semantics and what you call the various fees they charge, and a lawyer saw a way to make money.

There is no incentive for big businesses to rip off customers and make them leave or to sue you.

There is always an incentive to make terms and conditions so obfuscatory its impossible to establish legal blame and liability, becuase we live in such a litigious county with lawyers ready to sue for any reason.

The suit did nothing to improve ebay. It just made some lawyers rich. ya-hoo.

My part of the THIRTY-MILLION overcharged fees was TWENTY-THREE CENTS- LOL Somebody made a lot of money from that lawsuit- but it sure wasn't the Ebay members....

I think this is the same thing that happens with all of those class-action lawsuits against those medicines that are killing people- Only those lawyers are raking in the money-

Do you ever WONDER why Ebay charges a certain percent in fees for items in one category- and a different percentage for items in another category? WTH is that all about? Why not ONE predetermined percentage in ALL categories? Would THAT be too easy for us to keep up with?

Ebay does not LIKE simple- they are the author of confusion. I have found SO many over-charges in my invoices over the years- I don't think a SINGLE ONE has EVER been 100% correct.

At one point- I DID get Ebay to refund me for the numerous Picture-packs and Gallery Plus fees- that I never checked. We have to be SO careful in this area- When you list an item in a certain category- the Gallery plus and Picture Packs may be FREE...however when you use that same listing to LIST SIMILAR- and then CHANGE the category- they will then tack on the Gallery Plus and Picture Pack, only THIS time you are charged.

I now refuse to use Gallery Plus OR the Picture Pack- even when it is FREE, because I do not want this to be accidentally added to my next listing

Once- I bulk relisted about 25 items and EVERY ONE of those listings had $1.00 ADDED for Gallery Plus and I never had this option checked in the first place- Gallery plus and Picture Pack rakes in a LOT of money for Ebay!! Be CAREFUL. Check your invoices!! I cannot elaborate on this enough!

Just imagine...if Ebay 'accidently' overcharges you, along with a MILLION other members, only FIFTY-CENTS on each monthly invoice (something you probably would NEVER notice, if you list and sell a lot) THIS mere fifty-cents would add an additional $500,000 to Ebay's ever-growing fortune Each and EVERY MONTH!!

Another thing I often wonder about- Why have we NEVER heard from a disgruntled ex-Ebay worker? Isn't this a bit ODD? Do they sign an agreement with Ebay, when hired, that they will not reveal or disclose ANYTHING about what goes on in the Ebay business, or they will be fined or sued?

Its becuase profit margins are smaller in certain categories. Media items have very low margins, a FVF of 10% on a DVD likely is more than the seller is making. Categories like antiques and collectibles generally have higher profit margins than grocery items, and clothing used have the highest margin overall.

Its not uncommon in in commercial real estate/mall/shipping centers for there to be different percentages/rent for different type of stores.

However- the tax we pay on items we purchase stay the same? We're not talking STORES- we're talking EBAY- ONE PLACE where we sell. Why should THEY up the selling and listing fee on some items and not in others? How does it affect them? It's just another 'rule' in their Monopoly game. When we first started on Ebay, we KNEW what the listing fee would be- no matter WHAT we listed, as well as the final value fee. Betty Lou

If you can't see how basic economic laws of supply and demand affect the ebay fee structure then you need to read up on basic economics. (And its quite possible you shouldn't be in any business until you understand it.)
