We all know that "Search" didn't work right for store listings.
Also the RSS feeds did not export right to google all the time.
I found that when searching google for my listings, I found them but the link dumped nowhere close to my items. Thus making them unfindable / unbuyable.
This explains NO SALES for three months. Of course Ebay still wants the fees.
CS wouldn't listen at all. Canned responses.
Ebay has a policy of refunding fees for "Search Outages". I doubt they ever do. But that's what I'm asking for. I am asking for a credit of my last invoice.
The complaint was filed as a failure of service to Ebay Inc in CA.
If anyone has a class action lawsuit for this, let me know. |

Yes piles of people have files suits, individual and class actions,
some have been closed without further action, some have settled,
some are ongoing, and many have been gag-ordered. Some have
won, and some have lost. It all depends on the type of laywer you
got and the solidity of case you have.
GOOD LUCK!

Best of efforts to you with your case. While you have a strong case to start one, I did want to share another 'interesting' element. A few friends and I (geographically distributed here in the states) were all on a 3-way call one night. Long story short, we were using google-froogle to search.
They both had listings on ebaY, I did not. We all had listings on alternative sites. We all sell 'product' with enuf inventory to list on more than one site.
We spent an hour+ testing search results for our different products. Our findings were 'real eye-openers'....
1. Most free sites showed higher in the standard search results than ebaY (using key word searches, common titles amoung all sites with product).
2. We ALL got different results on our 'return'. In many instances, items that were page 1 for me, were page 4, 5 or other for them and the reverse was true also.
3. ebaY auction listings with a BIN were consistenty resulting in higher page ranks than same items in ebaY Stores.
These are just some points to share that may help you - I suspect you can do the same testing with folks and get the same results - as we repeated it a week later - with same/similar findings.
Best of efforts to you. I suspect they will 'just settle' as your monthly invoice 'credited' is probably less financial risk/burden than a court hearing!! :D :D  |
