GreenZap Inc. issued a press release to say it has filed a lawsuit against website-hosting-company Liquid Web Inc. and Vodien Inc. for a total of $57.5 million. GreenZap launched an online payment service in 2005. According to GreenZap's press release issued on Monday, "The suit is the first of many GreenZap is preparing against individual bloggers and hosting companies that maintain websites where defamatory comments are being posted concerning GreenZap and its executives."
The lawsuit was filed in November and includes greenzapscam.com as a defendant, although yesterday's press release made no mention of the site.
LiquidWeb stated in a court filing that it is not the host for greenzapscam.com and has never had any contract or agreement with greenzapscam.com. In January, it filed a Motion to Dismiss for Lack of In Personam Jurisdiction and for Failure to State Claim, and requested an award of attorney fees and costs. It also cited the Telecommunications Act of 1996, which it stated "provides immunity to providers and users of interactive computer services."

At first glance of this article, I was thinking to myself "where the heck did free speech go!?" I mean - I get snail mail solicitation all the time from companies bad-mouthing WalMart etc, and even we here at PSU gripe about sites - so if this company wins a court battle to say that even bloggers can't say anything negative about a company.... yikes
BUT THEN I READ FURTHER
...and it seems this is really a case about a parent company being the same host for GreenZap as it is for the bloggers... and now I kinda see the legal issue.
still... a little off the edge

Is GreenZap really still around ??!!
I thought they were fully exposed for the con they are long ago. Our courts are really in trouble if GZ is allowed to prevail in this.

| I do believe Precidence has already been set in issues like this. I also believe not only is the case going to be thrown out but also greenzap may have opened themselves up to legal issues/cost from filing on this issue. |
