And YOU thought eBay was bad: ioffer is WORSE !!!


I stopped selling DVDs and Blu-Ray on eBay in 2008 when the eBay V.E.R.O became to bad.
The eBay Verified Rights Owner (VeRO) Program got out of hand and forced many sellers offering legal products, like DVDs and CDs, into suspension.

So many then many sellers moved on to ioffer.

We listed 5 brand/new factory sealed Blu-rays on ioffer, we had bought two weeks earlier on Amazon:

Batman Begins [Blu-ray] (2005)
March of the Penguins [Blu-ray] (2005)
Twister [Blu-ray] (1996)
I Am Legend [Blu-ray] (2007)
300 [Blu-ray] (2007)


Two days later we received a notification from the Warner Brother C.O.P.S. (Counter Online Piracy System) that our listings were infringing on their copyright (which is 100% untrue), and our ioffer account was thus terminated.

We contacted the Warner Brother C.O.P.S., provided valid Amazon receipts POP (Proof of Purchase) for all items: WB did not care, or act on our behalf, apart from sending us a useless template suspension message.

ioffer does not care about people being unrightfully and unlawfully suspended sellers, stating it is none of their business: "iOffer Customer Service can not assist you with COPS removed items."

IN MY ENTIRE LIFE HAVE I NEVER BEEN TREATED WITH SUCH BLATANT DISRESPECT, BASICALLY LIKE A SMALL-TIME CROOK, OR CRIMINAL (WHICH I AM NOT)!


Ioffer is dying a slow similar eBay-like death by not standing up for their sellers, and being intimidated by WARNER BROS, for example. It is thus, NOT A VIABLE WEBSITE FOR SELLING, and serious, professional sellers will have to look elsewhere* to list their items.


WARNER BROS (WB) is a company that blatantly violates people's rights as consumer/customer.

You may not want to purchase any Warner Bros. products anymore (Myself, family and friends have stopped!) as WB continues to violate constitutional rights of others under the guise of copyright infringement. WB, today, has become Orwell's BIG BROTHER, it pretends and acts as if it is the police, or law enforcement, when, in all truth, it is just a privately held company, desperate for survival by bullying and intimidating others, and by default, others freedom and legal rights. In that way, WB itself has become involved in illegal activity, which seems to know no boundaries.

So, having said:

start selling and buying at companies*, which are NOT intimidated by VERO, or COPS systems, treat people like human beings and put the customer/consumer first; among them are:

After illegally taking down our brand/new factory sealed blu-rays, we purchased on Amazon.com, we emailed them the original Amazon purchase receipt for the Blu-Rays (POP) proof of purchase.

The person (or computer) there did not acknowledge us, help us, or act on our behalf, nor sent us an email; we were simply TERMINATED.

They then sent an email to ioffer at:

To suspend us, which ioffer always does for WB, it is WORSE than eBay VERO !!!!


Warner Bros is so desperate for money, they violate consumers' rights without hesitation!

Counterfeiters are pretty good at producing exact matches to the real product.

Maybe the factory sealed Bluerays were counterfeit on Amazon. Amazon is not immuned from fraud.

The factory bluerays probably have secret markings and the ones you received through Amazon didn't have the markings.

I got one item kicked off Ebay in the 5 years I've been selling and I was accused of putting the shipping price in the item description. That was B.S. and I had the Turbo lister copy to proove it. Ebay didn't care.

First thing you have to do is make sure your bluerays are authentic and not "Great Counterfeits" that are being sold on Amazon. Contact Amazon and ask them to check out the seller and tell them your story. They may kick the seller off Amazon that sold you your Bluerays.

If Ebay and Ioffer both gave the CD's the boot I'd like to hear the reasons why when you finally find out.

The only other thing I can think of is that they don't want the Bluerays being sold on the secondhand market yet. Maybe they aren't allowing people to buy directly from a licensed dealer then turn around and resell them at a higher price.

Bluerays are "Hot" right now and I'd like to get ahold of a couple of cases of them for profit also. Me and every other seller on Ebay would like to turn a profit on the Bluerays if we could find them.

I have read and heard first hand about folks being screwed by a Big company [insert name of bank, cable or auction co. ]. The commonly successful solution, is to Take Them To Small Claims Court. I know, you're saying ''they'll destroy me with all of their lawyers''. How much do they pay said lawyers to fly out to your court case, and hotels and meals. They Will Not Send one. It is far too much hassle and expense for them. and they will settle out of court and agree to a cease and desist in YOUR favor. How much is it to file a case? $25? AND you have the proof to win. A small risk. Try it. $25 is not much compared to your potential profit. Research this plan online--- and see folks having their BANK FEES cancelled. Phone Charges, etc.

Most states have a little article in their small claims rules that states.. where the defendent resides.

Small claims court doesn't use lawyers. A lawyer may be consulted prior to court, but cannot represent the plantiff or defendent in court.

Ever see an attorney represent someone on People's Court?

They will still give up, because they do not want to waste one minute of their precious time. They would have to send someone to court. Someone accustomed to staying at 5 star hotels with fine dining. Even if they do fight , there is nothing they could do to legally justify themselves. Ok, file in your home county. I live in CA... so all references are to CA law.

Then someone from the WB legal dept will write a letter challanging venue... the defendent does not have to appear if they wrie the letter challenging the venue.

BUT the plantiff must appear on the assigned court date. The defendant's letter will be read at that time, and the plantiff will have opportunity to challenge the defendent's challenge. the judge will decide if his court is proper venue or not. If proper, a new court date will be assigned. OR if improper... the plantiff must refile in the defendents county. And case dismissed without prejudice. meaning refile in proper county, the defendent's home county. Oh yeah, the plantiff will also lose the filing fees... in CA.. $25 - about $75 depending on how much the plantiff is suing for.

Now if it were me... I would challenge the venue first. Then when decided and new court date set or refiled, send a law clerk, someone not a member of the bar yet.

Or they can ask the court for a mediator.

I haven't paid attention to where OP was from... CA you can sue for Max $7500 if an individual or $5000 if a business, and can collect punitives. And businesses do take other businesses and individuals to small claims.

In CO, you cannot sue for punitives.
